En fastighetsköpares talan mot säljarna om att köpet skulle hävas på grund av kvalitetsfel på fastigheten hade förkastats genom en lagakraftvunnen dom. Denna dom hindrade prövning av en mot säljarna senare väckt talan i vilken köparen yrkade prisnedsättning på grund av samma fel. (Omröstn.) Se KKO 2001:136 KKO 2008:43
