Tredje man hade i god tro köpt en bil. Stadgandena om åtkomstskydd var inte tillämpliga, då bilen hade stannat i rätte ägarens besittning.

Då ägaren inte varit vållande till skadans uppkomst, var han inte heller skyldig att ersätta den skada tredje man lidit på grund av att han erlagt betalning för bilen till sin fångesman.
