A ja B olivat uhkaillen ja kiviä heittelemällä pelästyttäneet iäkkään D:n niin, että D oli saanut hengenvaarallisen sydämen rytmihäiriökohtauksen. Kun A ja B siten varomattomuudellaan olivat aiheuttaneet D:lle sairauden, menettely luettiin heidän syykseen ruumiinvamman tuottamuksena.
