Kun velallinen oli perustanut takavarikon kumoamiseksi tekemänsä muutoksenhakulupa-anomuksen yksinomaan siihen, että takavarikkoon pantu omaisuus kuului kolmannelle henkilölle, ei anomusta otettu tutkittavaksi.
