Kun jutussa ilmi tulleet seikat tukivat väitettä, että hevosten vaihdossa maksettavaksi sovittu väliraha oli suoritettava ainoastaan mikäli A:n saama tamma varsoi, eikä B ollut näyttänyt, että vaihtosopimus olisi tehty ilman tuollaista ehtoa, B:n vaatimus välirahan maksamisesta hylättiin.
