Kun uusi omistaja, joka oli ostanut tilan ennen kuin se oli ulosmitattu edellisen omistajan velasta, oli UL 4 luv. 26 §:n 2 mom:ssa tarkoitetussa ajassa saanut lainhuudon tilaan eikä uloshaettu saaminen ollut sellainen, että tila oli siitä vastuussa, ulosmittaus julistettiin peräytyneeksi.
