Kun oli selvitetty, että oy oli vain näennäisesti erillinen yhtiö mutta tosiasiallisesti toisen yhtiön omistama ja sen taloudellisia tarkoituksia varten toimiva itsenäisen hallinnon alainen tytäryhtiö, viimeksi mainitulla yhtiöllä ei voinut olla saamista ensiksi mainitun yhtiön nimessä olleesta konkurssiin luovutetusta omaisuudesta.
