Omistajan vapaaehtoisesti hallustaan antamaa, haltijalle asetettua panttaustodistusta kolmas mies, joka oli saanut sen hyvässä uskossa haltuunsa, ei ollut velvollinen luovuttamaan KK 11 luv. 4 §:ssä ja 12 luv. 4 §:ssä säädettyä lunastusta vastaan.
